Section 106 Agreements
Section 106 agreements are legally binding documents between a planning authority and a developer under the Town and Country Planning Act 1990. They are used to help mitigate the effects of larger developments on local infrastructure. These planning obligations must be:
• Necessary to make the development acceptable in planning terms
• Directly related to the development
• Fairly and reasonably related in scale and kind to the development
The most common obligations with the Forest of Dean District Council include the delivery of affordable housing, local areas of play, youth and adult recreation provision, and environmental enhancements.

Section 106 Compliance Queries
Confirmation that Section 106 planning obligations have been complied with incurs a fee. Details can be found on our Get advice on your planning application page.
We require either a local search document or the relevant planning reference(s) in order to process a request.
Please send requests to the Planning Support Team at planning@fdean.gov.uk.
Once the relevant fee has been paid, a confirmation letter will be sent. We aim to respond within 28 days. However, more complex queries may require site visits to ensure compliance, and we are reliant on up-to-date communication from the developer.
Infrastructure Funding Statement
Our annual Infrastructure Funding Statement provides a list of financial and non-financial developer contributions relating to Section 106 agreements within the district. These can be viewed under Supporting information for the Local Plan 2041 section.
